EULA - End User License Agreement

IMPORTANT-READ CAREFULLY: This Pyxis Backup Software (“SOFTWARE”) End-User License Agreement ('EULA') is a legal agreement between you (either an individual or a single entity) and MTBS Software. By installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE.
1. The SOFTWARE is licensed, not sold.
2. GRANT OF LICENSE.
a/ One month trial version of SOFTWARE is free to use for anyone and it can be freely distributed. Trial version has unlocked all features. It’s highly recommended to try out all features thoroughly before purchase.
b/ After the purchase and have received license key, MBTS Software grands you non-exclusive rights to install and use the SOFTWARE on one computer strictly in accordance with the terms and conditions of this License Agreement. You can transfer license to your own other computer.
3. RESTRICTIONS.
You may not reverse engineer, de-compile, or disassemble the SOFTWARE, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. You may not sell, rent, lease, or lend the SOFTWARE. You may not publish or publicly distribute any license keys, serial numbers that would allow a third party to activate the SOFTWARE without a valid license.
4. LIMITATION of RESPONSIBILITY.
The SOFTWARE is distributed 'AS IS', it is recommended to test the SOFTWARE before purchasing. The Licensor is not liable for malfunctioning of the Software resulting from the disability of the equipment used by the Licensee, improper use of the program or resulting from the operation of computer viruses
With the exception of obligations resulting from infringement of intellectual property rights, the Licensor total liability, if any, arising or in any way related to the use or inability to use the SOFTWARE, is limited to the purchase price, that is USD 12; in no case may the Licensor or its licensors or suppliers pay for accidental, indirect, special or consequential damages, even if they have been informed of or should have foreseen the possibility of such damages.
5. GOVERNING LAW
The laws of Poland, excluding its conflicts of law rules, shall govern this Agreement and your use of the Application. Your use of the Application may also be subject to other local, state, national, or international laws.
